Terms of Use
These Terms of Use ("Terms") govern your access to and use of Calmate, a calorie, meal, hydration, weight, and nutrition planning app provided by Pebblework Labs ("Pebblework Labs," "we," "us," or "our"). By using Calmate, you agree to these Terms.
Eligibility
You must be at least 13 years old to use Calmate. If you are under the age of majority where you live, you may use Calmate only with permission from a parent or legal guardian.
General Wellness Only
Calmate is provided for general wellness, nutrition tracking, and informational purposes only. It is not medical, nutritional, or professional advice and should not be used to diagnose, treat, cure, or prevent any disease or health condition.
Always consult a qualified healthcare professional before making significant changes to your diet, exercise, weight, hydration, or health routines, especially if you are pregnant, nursing, have a medical condition, have a history of eating disorders, take medication, or follow a medically supervised plan.
Nutrition and AI Estimates
Calmate may provide calorie, macro, food, meal, exercise, and plan estimates based on information you enter, photos you submit, barcode lookups, or AI-powered processing. These outputs may be incomplete, inaccurate, or inappropriate for your specific circumstances. You are responsible for reviewing and verifying information before relying on it.
Your Responsibilities
You agree not to:
- Use Calmate for emergency, clinical, diagnostic, or medical decision-making.
- Submit information you do not have the right to submit.
- Misuse Calmate, interfere with its operation, or attempt to access systems or data without authorization.
- Use Calmate in violation of applicable law or third-party rights.
- Reverse engineer, copy, modify, distribute, sell, or lease any part of Calmate except as allowed by law.
Subscriptions and In-App Purchases
Some Calmate features may require a paid subscription or in-app purchase. Purchases are processed by Apple through your Apple ID and are subject to Apple's payment terms. Subscription pricing, duration, trial availability, renewal terms, and included features are shown in the app before purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID account settings. Refunds, if available, are handled by Apple under Apple's policies.
App Availability and Changes
We may modify, suspend, or discontinue Calmate or any feature at any time. We may also update these Terms as the app changes. If we make material changes, we will update the effective date above. Your continued use of Calmate after changes become effective means you accept the updated Terms.
User Content
You retain ownership of information, text, images, and other content you submit to Calmate. You grant us a limited right to process that content as needed to provide, maintain, secure, and improve Calmate and related services.
Privacy
Our Privacy Policy explains how we handle information in connection with Calmate. By using Calmate, you acknowledge that you have read the Privacy Policy.
Third-Party Services and Data
Calmate may rely on third-party platforms or services, including Apple services, AI processing providers, and food database providers. We are not responsible for third-party services, content, data, or policies. Third-party services may change, become unavailable, or return inaccurate data.
Intellectual Property
Calmate, including its software, design, name, branding, text, graphics, and other materials, is owned by Pebblework Labs or its licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in Calmate.
No Warranty
Calmate is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted or error-free operation.
Limitation of Liability
To the fullest extent permitted by law, Pebblework Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or health-related outcomes arising from or related to your use of Calmate.
Indemnity
You agree to defend, indemnify, and hold harmless Pebblework Labs from claims, liabilities, damages, losses, and expenses arising from your use of Calmate, your content, or your violation of these Terms.
Termination
We may suspend or terminate access to Calmate if you violate these Terms or use the app in a way that may create risk or legal exposure for us, other users, or third parties. You may stop using Calmate at any time.
Governing Law
These Terms are governed by the laws of the United States and the laws of the state where Pebblework Labs is established, without regard to conflict-of-law principles, unless local law requires otherwise.
